Welcome to FunkyPop. These Terms & Conditions (“Terms“) govern your access to and use of the FunkyPop service available at https://funkylancers.com/pop (the “Site“).
FunkyPop is operated by Solo Consulting LLC, a limited liability company formed under the laws of the State of Wyoming, United States, with business address at 542 Washington Ave, Miami Beach, Florida, United States (“we“, “us“, “our“, or the “Company“).
By creating an account, subscribing, or otherwise using FunkyPop, you (“you“, “Customer“, “Buyer“) confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.

By using FunkyPop you represent and warrant that you meet these requirements.
FunkyPop is a subscription-based SaaS that gives Customers access to a custom suite of AI coaches modeled on the founder’s experience, methodology, and voice. The AI coaches generate text responses to questions and prompts submitted by the Customer.
AI-generated content. All Outputs are generated automatically by artificial intelligence models. You acknowledge and agree that:
No training on your conversations. We do not currently use your Inputs, conversations, or Outputs to train or fine-tune AI models. Your data is processed solely to deliver the Service to you. If this practice ever changes, we will update these Terms, notify you in advance by email, and give you the opportunity to cancel your Subscription before the change takes effect.
Prices. Subscription prices are shown on the Site at checkout. Prices may change from time to time. Any change will apply from your next billing period and will be communicated to you at least 30 days in advance by email or through a notice on the Site. You may cancel your Subscription before the price change takes effect; if you do not cancel, the new price will apply from your next renewal.
Currency. Prices are charged in US Dollars (USD). LemonSqueezy may display approximate prices in Euros or other local currencies for your convenience, but the actual transaction is processed in USD. Your bank or card issuer may apply currency conversion fees.
Merchant of Record. Payments for the Service are processed by LemonSqueezy, which acts as the Merchant of Record for your purchase. This means LemonSqueezy:
Your purchase is also subject to LemonSqueezy’s own terms and privacy policy, available on its website.
Subscription billing. Subscriptions are offered on a monthly or annual billing cycle, selected by you at checkout. The applicable fee is charged in advance at the start of each billing period. Subscriptions renew automatically at the end of each billing period at the then-current price until cancelled in accordance with Section 7.
Your order is accepted when LemonSqueezy confirms successful payment. After payment confirmation you will receive an email with instructions to access your Account.
Access to FunkyPop is delivered electronically and is typically available immediately after successful payment. There is no physical product and no shipment.
You acknowledge that the Service is delivered as a digital service and that performance begins as soon as you access your Account.
14-day money-back guarantee. We offer a 14-day money-back guarantee from the date of your initial purchase of a Subscription. If, within 14 days of your first purchase, you are not satisfied with the Service, contact us at [email protected] to request a refund. Refunds are processed by LemonSqueezy as Merchant of Record and credited to your original payment method.
The 14-day guarantee applies to the initial purchase only. Subscription renewals are not covered by this guarantee.
After the 14-day window. After the 14-day window has expired, no refunds are issued, including for partial billing periods. You may cancel future renewals at any time, as described below, but the current billing period will not be refunded.
Cancellation. You may cancel your Subscription at any time through the customer portal provided by LemonSqueezy or by contacting us at [email protected]. Cancellation stops future renewals. Your access to the Service continues until the end of the billing period you have already paid for.
Data after cancellation. After cancellation or Account deletion, your conversation data is retained for 60 days, during which you may request an export. After 60 days the data is deleted in accordance with our Privacy Policy.
Mandatory consumer rights. Nothing in this Section limits any mandatory consumer rights you may have under the law of your country of residence. See Section 18 for EU and UK consumers.
Subject to your compliance with these Terms and payment of all applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own personal or internal business purposes.
You agree to use the Service only:
Our IP. The Service, including all software, AI models, prompts, designs, branding, text, graphics, and other content provided by us, is owned by Solo Consulting LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. These Terms do not transfer any ownership of the Service to you.
Your Inputs. You retain ownership of the Inputs you submit. You grant us a limited, worldwide, royalty-free license to process your Inputs solely to operate and deliver the Service to you.
Outputs. Subject to your compliance with these Terms, you may use the Outputs generated for you for your own personal or internal business purposes. Because of the nature of AI, similar or identical Outputs may be generated for other Customers, and we make no claim of exclusivity over any specific Output.

The Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted or error-free operation.
We do not warrant that:
You assume full responsibility for any decisions you make based on the Service.
To the maximum extent permitted by applicable law, in no event shall Solo Consulting LLC, its officers, members, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, revenue, data, goodwill, or business opportunities, arising out of or in connection with the Service or these Terms, whether based on contract, tort, negligence, strict liability, or any other legal theory.
Our total aggregate liability to you for any and all claims arising out of or related to the Service or these Terms shall not exceed the greater of:
Nothing in these Terms limits any liability that cannot be limited or excluded under applicable law, including liability for fraud, gross negligence, willful misconduct, or death or personal injury caused by negligence.
You agree to indemnify, defend, and hold harmless Solo Consulting LLC, its officers, members, employees, agents, and licensors from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:
Our handling of personal data is described in our Privacy Policy, available on the Site. By using FunkyPop you acknowledge and agree to that policy.
Payment data is collected and processed by LemonSqueezy as Merchant of Record. We do not store or have access to your full payment card details. LemonSqueezy’s handling of your payment data is governed by its own privacy policy, available on its website.
As stated in Section 4, we do not currently use your conversations, Inputs, or Outputs to train or fine-tune AI models.
We may update these Terms from time to time. When we make changes, we will:
Continued use of the Service after the changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you may cancel your Subscription before they take effect.
By you. You may stop using the Service and cancel your Subscription at any time as described in Section 7.
By us. We may suspend or terminate your Account and access to the Service:
Effect of termination. Upon termination, your right to access the Service ceases immediately. Sections that by their nature should survive termination (including Sections 9, 10, 11, 12, 13, 14, 17, and 18) will survive.
These Terms and any dispute arising out of or related to them or the Service are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law principles.
Subject to Section 18, any dispute shall be brought in the state or federal courts located in the State of Wyoming, and you consent to the personal jurisdiction of those courts.
Nothing in this Section limits any mandatory consumer protection rights you may have under the law of your country of residence, including the right to bring proceedings in the courts of that country.
If you are a consumer resident in the European Union or the United Kingdom, you have additional rights under applicable consumer protection law that are not affected by these Terms.
Right of withdrawal. EU and UK consumers normally have a 14-day right of withdrawal for contracts concluded online, including for digital services.
Immediate access. FunkyPop provides immediate access to a digital service upon subscription. By subscribing and beginning to use the Service before the 14-day withdrawal period expires, you expressly request immediate performance and acknowledge that you may lose your statutory right of withdrawal once the Service has begun to be supplied.
Voluntary 14-day money-back guarantee. In addition, we offer a voluntary 14-day money-back guarantee on your initial purchase as described in Section 7. This is offered in addition to, and does not replace, any mandatory consumer rights.
Statutory rights preserved. Your mandatory consumer rights under the law of your country of residence, including rights to a remedy for non-conforming digital services, are preserved and unaffected by these Terms.
Consumer forum. You retain the right to bring proceedings in the courts of your country of residence to enforce mandatory consumer rights.
